I was false accused for business robbery and I stay 2 years in custody. I want to sue the police.
The following explanation was posted as comment below after ProBonoMatters probed to get more detail.
I was staying Vredendal and I was visiting my brother in Lutzville, in the Western Cape, when I was wrongfully arrested by members of the South African Police Services (SAPS).
It was 13 November 2014 and I went to the shop in Lutzville to buy myself a drink. I came out of the shop with my drink and waited for a taxi under the shade in front of the shop.
While I was waiting for the taxi to take me to my brother’s place, two police officers came along. They searched me and found my passport, bank card and R400.00 (four hundred rands) in my pockets.
Then the police took me to the police station. When I asked them what crime did I commit, they tome I’m a suspect in a robbery. They told me there was a robbery at one of the farm offices and they were looking for two guys who robbed the farm.
After about 20 minutes, the police arrested those two guys who committed the crime and charged them for business robbery and assault. And they still charged me for business robbery and assault. I became accused number 3.
I went to jail. The police did the investigation for that case. All the evidence was for two guys which should have excluded me. All the witnesses from the crime scene who came to testify pointed to the two guys and not me.
I stayed two years in custody for the crime which I did not commit. I believe that the police took advantage of me because I’m a Zimbabwean. The state dropped the charged against me on 2 November 2016. I was found not guilty. I don’t have any criminal record in my life. So what can I do?
