Our municipality has issued a draft rates policy for which objections close on 15 March. However, the policy does not specify a cent in rand tariff as, to my understanding, required by Section 14.2 (b) (iii) of the Local Government Municipal Property Rates Act of 2004, as amended 2014. I want to get the draft policy declared invalid. There are other wide-ranging issues which will cause pretty much the whole agricultural community’s rates and taxes to increase by a minimum of 150%, even if there was no increase in their municipal valuation. Midvaal currently has one of the highest residential tariffs in the country, 1.6947 cents in the rand (more than City of Joburg’s commercial tariff). We will raise funds if necessary, but for now I would just like advice about whether we can challenge the validity of the draft rates policy, and how to go about it.
